WORK OBJECTIVE:

This is responsible supervisory, administrative, and technical work in the investigation, negotiation and settlement of public liability, property damage, and bodily injury claims. An employee in this class is responsible for developing, managing, and revising operational procedures, interpreting, and applying laws and regulations and maintaining working relationships with attorneys, physicians, insurance companies, governmental agencies and the public. Assignments are generally broad in scope with frequent opportunity for exercising independent judgment in making claims management decisions subject to final review and approval by the Director of Risk Management and/or Office of General Counsel.

ESSENTIAL FUNCTIONS:

The omission of an essential function does not preclude management from assigning duties not listed herein if such duties are a logical assignment to the position. • Plans, organizes, and reviews the investigation, negotiation, and settlement of a variety of self-insured claims and insured claims, through the NFTA/NFT Metro’s status as Additional Insured. • Reviews accident reports, losses, and litigation claims; provides subordinates and intradepartmental personnel with technical advice and assistance. • Investigates, evaluates, and resolves claims made by and against NFTA/NFT Metro. • Negotiates with individuals, insurance companies and attorneys to affect an equitable settlement; supervises the collection of subrogation monies. • Prepares departmental budget. • Reviews and coordinates defense preparation with defense attorneys in litigation. • Collaborates extensively with the Office of General Counsel in evaluating claims, establishing, and changing reserves and settling claims. • Reviews, approves within specified limits, and recommends payments made by NFTA/NFT Metro for insurance claims. • Attends conferences, workshops, and meetings to ascertain new development or changes in laws and practices pertaining to the insurance industry. • Supervises, trains, assigns, and reviews work of personnel performing a variety of duties in connection with the examination and adjustment of insurance claims including complex claims involving the potential for extensive liability. • Evaluates and oversees handling of no-fault claims including authorizing payment or denial and ensuring compliance with insurance department regulations. • Evaluates all claims, maintaining reserves and preparing reports of same. • Ensures the Assure Claims system, the system of record for claims, is accurate and fully utilized. • Maintains records of all claims and prepares regular reports detailing same. • Perform additional duties and task as assigned.

KNOWLEDGE, SKILLS and ABILITIES:

Knowledge of the statutes, laws, and regulations applicable to liability, property damage and bodily injury claims. Knowledge of liability claims administration and the techniques of investigation, adjustment, negotiation, and settlement. Knowledge of litigation preparation as related to evidence, admissible statements, and medical testimony. Detailed knowledge of medical practices and terminology. Knowledge of auto liability, general liability, professional liability, and property insurance policy coverages. Knowledge of State of New York’s Law and claim processes with particularly complete knowledge of NYS No-Fault Law and Regulations including APIP, OBEL, UM AND SUM coverage. Ability to conduct effective negotiations with claimants, attorneys and insurance carriers. Ability to express ideas clearly and concisely, verbally and in writing. Ability to analyze facts and to exercise sound judgment in arriving at conclusions. Ability to train and supervise the work of subordinate employees. Thorough knowledge of Microsoft Office products including Word, Excel & Access.

PHYSICAL REQUIREMENTS:

Tasks involve the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds).

ENVIRONMENTAL REQUIREMENTS:

Work is performed in usual office conditions with rare exposure to disagreeable environmental factors.

MINIMUM QUALIFICATIONS:

A Bachelor’s degree and at least ten (10) years’ experience in administering and managing insurance claims, or an equivalent combination of education, training, and experience.
