WORK OBJECTIVE:
This is responsible professional level legal work of significant complexity involving delivery of a variety of legal services to NFTA. Legal services include the review and/or preparation of legal documents and the preparation of briefs and legal opinions. Responsibilities may include representation of NFTA or various departments in litigation and/or administrative proceedings. Work is performed under the supervision of the General Counsel and is reviewed through observation, conferences, reports and evaluation of results achieved.
ESSENTIAL FUNCTIONS:
The list of essential functions, as outlined herein, is intended to be representative of the tasks performed within this classification. It is not necessarily descriptive of any one position in the class. The omission of an essential function does not preclude management from assigning duties not listed herein if such duties are a logical assignment to the position.
• Conducts legal research concerning legal problems or projects, and prepares reports, memoranda and opinions containing proposed or recommended courses of action.
• Conducts investigations and interviews based upon alleged or potential legal problems, and prepare reports or opinions based upon findings made.
• Represents various departments in administrative and judicial proceedings.
• Prepares resolutions and other proposed legislation.
• Prepares contracts and other legal documents.
• Prepares pleadings, discovery documents, motions, briefs, and all other legal documents in matters involving litigation and arbitration.
• Represents the Authority on various outside committees.
• Represents the NFTA in all phases of administrative proceedings before the New York State Division of Human Rights, the Equal Employment Opportunity Commission, and the Public Employment Relations Board, among others, including investigating and answering charges or complaints, as well as handling any administrative hearings before such entities.
• Represents the NFTA in State Supreme court proceedings, including CPLR Article 75 and Article 78 matters, including applying for as well as opposing proceedings to stay of arbitration in State Supreme Court.
• Reviews Union grievances and provides assistance to Director of Labor Relations to answer grievances as needed.
• Represents the NFTA in grievance arbitration hearings, including assisting with gathering facts, preparing witnesses and documents for hearing, and presenting or defending grievances before arbitrators.
• Represents NFTA in Federal Court litigation, including Title VII, ADA, FMLA, as well as other matters involving Federal employment laws.
• Represents NFTA in State Court litigation including NYSHRL, as well as other matters involving employment laws of the State of New York.
• Assists with collective bargaining and negotiations as needed and support Labor Relations in all related PERB proceedings concerning collective bargaining at the NFTA.
• Reviews and/or drafts grievance settlements and severance agreements.
• Provides day to day support to address questions concerning employee discipline and contract interpretation and application, including reviewing discharge notices, decisions to discipline, and communications with employees or Unions on contract matter.
KNOWLEDGE, SKILLS and ABILITIES:
Considerable knowledge of the principles, methods, materials and practices of legal research. Considerable knowledge of the laws of New York, institutional law, local legislation pertaining to NFTA, and administrative law and regulations including in particular matters pertaining to labor and employment litigation, arbitration hearings, and associated Federal and State administrative proceedings. Ability to deal tactfully and effectively with officials, employees, court officials and the general public. Ability to draft legal instruments, proposed legislation and legal opinions. Ability to effectively represent NFTA in litigation and administrative proceedings.
PHYSICAL REQUIREMENTS:
Tasks involve the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds).
ENVIRONMENTAL REQUIREMENTS:
Work is performed in usual office conditions with rare exposure to disagreeable environmental factors.
MINIMUM QUALIFICATIONS:
Graduation from an accredited law school with a Juris Doctor degree or equivalent, possession of a State of New York license as a practicing attorney and admission to the New York State Bar, and five (5) years of professional experience as an attorney, three (3) of which must involve labor and employment law; public sector and/or governmental experience is preferred.
