WORK OBJECTIVE:
Acts as the lead officer in developing, implementing, monitoring, and revising the Disadvantaged Business Enterprise (DBE) program pursuant to 49 CFR 26. Specific responsibilities include compilation and analysis of statistical data relevant to the establishment of required DBE goals, the accurate maintenance of certification records, the detailed creation of internal and federally mandated reports, and the investigation of DBE compliance complaints. Serves as the DBE liaison for community members and business owners, as well as municipal, state, and federal departments concerning compliance, certification, and procurement. Additionally responsible for the training and record keeping of harassment and discrimination as well as the assistance in internal investigations and Title IV and EEO reporting.
ESSENTIAL FUNCTIONS:

• Review and evaluate applications from business enterprises seeking DBE/ACDBE certification. Analyze applications and support documents to verify full disclosure of ownership, finances, and control of the business enterprise in accordance with federal regulations.
• Make individual determinations on whether businesses meet certification eligibility requirements and prepare written assessments and application summaries recommending approval or denial. Confers with management on legal and complex issues relating to applications and compliance.
• Interprets DBE policies and guidelines to contractors, business owners, and departmental managers.
• Participates in outreach events/efforts on behalf of the NFTA to provide information and promote the DBE certification program; leads workshops, providing technical assistance and information to participants to explain the application process, certification/compliance requirements, reporting requirements and penalties for non-compliance on federally funded projects.
• Conducts site visits of construction projects to monitor contract compliance with DBE requirements, EEO guidelines, and other federal, state, and local requirements.
• Conduct desk audits, visit field locations, and assist the Chief Diversity Officer with investigations complaints including but not limited to DBE/ACDBE program, harassment, and discrimination.
• Conducts close-out audits to evaluate overall contract compliance by vendors.
• Provides annual training to new and current employees on company EEO policies and procedures.
• Creates and maintains databases of work activities, application reviews and other assignments as they relate to DBE certification and EEO harassment training.
• Prepares detailed narrative and statistical work reports on all DBE federally funded projects; prepares correspondence and maintains contract related files.
• Reviews vendors employment and payroll records to ensure compliance with federal labor laws and payments to DBE vendors.
• Investigates complaints filed by business enterprises alleging discrimination or prohibited bias in regard to their DBE certification status.
• Assist the Chief Diversity Officer with completing DBE/ACDBE reporting.
• Attend pre-proposal meetings and explain Executive Order 187 responsibilities, DBE requirements and participation goals.
• Establishes and maintains effective working relationships with DBE’s, Federal, State, local agencies, civic, non-profit, and community groups in the implementation of various components of the DBE/ACDBE Program.
• Provide and brief Chief Diversity Officer summary reports from investigations.
• Provides direction to Administrative Assistant on DBE/ACDBE related matters.
• General administrative duties, including filing, purging, etc.
• Assist with other areas in the department. To include, but not limited to AAC and ADA requirements.
• Conducts internal Title IV investigation and assists with reviews.
• Performs other duties as assigned.
KNOWLEDGE, SKILLS and ABILITIES:
Knowledge of the legal basis for affirmative action and equal opportunity programs. Ability to organize, and analyze facts, and communicate effectively both verbally and in writing. Ability to interpret Federal regulations in complex, sensitive or new situations, exercise judgment and discretion in the review of submitted documentation and when monitoring projects and concessionaires.
PHYSICAL REQUIREMENTS:
Tasks involve the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds).
ENVIRONMENTAL REQUIREMENTS:
Work is performed in usual office conditions with rare exposure to disagreeable environmental factors.
MINIMUM QUALIFICATIONS:
Bachelor’s degree and two years’ experience working on affirmative action programs, diversity development, human resources or an equivalent combination of education and experience. A valid New York State driver’s license for use of personal automobile may be required and must be able to obtain airport clearance. Must be skilled in the use of Microsoft office.
